- retaliatory statute
- A statute of one state, the purpose of which is to be as onerous to the citizens or corporations of another state as a statute of the latter is to citizens or corporations of the former, for example, a statute imposing upon foreign corporations the same taxes, fees, and penalties as are imposed by the home state of the corporation upon corporations of the taxing state. A statute providing that whenever the laws of a particular state impose greater burdens and limitations upon insurance companies organized in the enacting state, and doing business in such other state, than are imposed by the laws of the enacting state upon foreign insurance companies doing business in that state, then the same burdens and prohibitions imposed by the foreign state shall be imposed by the enacting state upon such insurance companies of the foreign state. 29 Am J Rev ed Ins § 71. Statutes providing that where the laws of another state provide for the levy of taxes upon liquor products manufactured outside the state and sold and dispensed within the state, in excess of the taxes, fees, and charges on the liquor products of manufacturers of such state, the same or additional taxes, fees, and charges are to be levied upon the liquor products of manufacturers of such state. 30 Am J Rev ed Intox L § 203.
