The doctrine which prevails in some American jurisdictions that the person who first diverts and applies to a beneficial use the waters of a stream of public right has a prior right of continued use to the extent of his appropriation. Wyoming v Colorado, 259 US 419, 66 L Ed 999, 42 S Ct 552. The doctrine of the western states concerning the use of water for irrigation. 30 Am J Rev ed Irrig § 18.
