Narrowly, one of a group related by blood or marriage. Sometimes limited to a close relative, such as widow, child, or parent. Fennimore v Pittsburg-Scammon Coal Co. 100 Kan 372, 164 P 265 (workmen's compensation statute). Broadly, one of a group living in the same household. Within the meaning of a statute permitting substituted service of process upon the defendant in an action by leaving a copy with a "member of his family":–any person living permanently and continuously with the defendant in the same domestic establishment. Anno: 136 ALR 1505. The purpose of a clause of an automobile liability insurance policy excluding from coverage an injury to "any member of the family of the insured residing in the same household as the insured" is to exempt the insurer from liability to those persons to whom the insured, on account of close family ties, would be apt to be partial in case of injury, and cases defining the word "family", but involving an entirely different situation, are not authoritative. Tomlyanovich v Tomlyanovich, 239 Minn 250, 58 NW2d 855, 50 ALR2d 108. The question as to who is a member of the insured's "family" within the coverage clause of a property insurance policy depends upon the precise terminology of the particular policy involved and the particular circumstances present.
