In jail or prison. Under the direct or indirect restraint of an officer of the law armed with authority to restrain. A prisoner who is at large on bail is not in custody, but, although a prisoner to whom a parole has been granted is permitted to go and remain at large under the supervision of the court, he is held to be in custody.
